Environmental constitutionalism is the inclusion of environmental rights, duties, and principles in a country’s constitution. In IB ESS, it is HL-only content in HL.a Environmental law.
How Environmental Constitutionalism Works
A constitution is a country’s highest source of domestic law. Constitutional protection therefore has greater authority than ordinary legislation and can require governments, businesses, and citizens to act consistently with environmental rights and obligations.
The mechanism works in four stages:
- The constitution recognizes a human right to a healthy environment or grants legal protection to nature itself.
- Governments must consider that provision when making policy, approving development, and enforcing environmental law.
- Citizens, communities, or organizations may challenge decisions through the courts.
- Courts interpret the provision and may cancel permits, require restoration, or order government action.
| Potential strength | Limitation |
|---|---|
| Gives environmental protection high legal status | Broad wording may be difficult to interpret |
| Allows courts to review government decisions | Enforcement depends on accessible and independent courts |
| Can support environmental justice for affected communities | Legal action may be unaffordable for marginalized groups |
| Creates obligations beyond short political cycles | Economic priorities and lobbying may weaken implementation |
Named Example: Ecuador
Ecuador’s 2008 Constitution recognizes the rights of nature, protecting nature beyond its usefulness to humans. In the 2021 Los Cedros case, Ecuador’s Constitutional Court ruled that mining permits threatened these rights and required stronger protection of the cloud forest.
This reflects an ecocentric perspective and can promote environmental justice by giving communities a legal basis to resist damaging development. However, constitutional recognition does not guarantee protection unless laws are enforced and judgments are implemented.
Exam Technique
For an explain question, define the term and trace the mechanism from constitutional right to judicial enforcement. For evaluate, balance high legal authority against practical enforcement limits, use Ecuador as a named example, and finish with a supported judgment.
