The Tyranny of the Majority

Democratic Tyranny and its Two Forms

1. John Stuart Mill argues in On Liberty that the transition from absolute monarchy to democratic government did not eliminate the danger of tyranny but transformed it. Under democracy, the “people” who exercise power are not the same people over whom it is exercised.
   1. The majority can oppress minorities just as effectively as any despot, and this oppression is often harder to resist because it carries the legitimacy of popular will.
2. Mill's concern builds on Alexis de Tocqueville's analysis in Democracy in America (1835). Tocqueville observed that democratic societies tend toward a distinctive form of soft despotism in which the majority does not physically coerce dissenters but smothers independent thought through the sheer weight of public opinion.
   1. Mill draws directly on Tocqueville's insight that social tyranny can be more pervasive than political tyranny.
3. The tyranny of the majority operates through two channels. First, through legislation that reflects majority preferences without regard for minority rights.
   1. Second, and more insidiously, through social pressure: stigma, ostracism, and the withdrawal of approval from those who deviate from prevailing norms. Mill argues that the second form is often more dangerous because it penetrates into everyday life and leaves its victims no institutional avenue of appeal.
4. Mill connects this analysis to his defence of the harm principle (10.12.1). The harm principle functions as a constitutional limit on majority power: regardless of how many people disapprove of a particular behaviour, they have no right to suppress it unless it causes harm to others.
   1. This places individual liberty beyond the reach of democratic decision-making on matters that concern only the individual.
5. The concept of legitimate government authority is central to Mill's argument. He contends that government exists to protect individuals from harm and to provide public goods, not to impose moral or religious standards on its citizens.

Manifestations and Constitutional Responses

1. Any exercise of government power that goes beyond these functions is illegitimate, regardless of how many citizens support it. Mill thus articulates a distinctively liberal theory of limited government.

1. Mill identifies religious intolerance as a paradigm case of majority tyranny. Throughout history, dominant religious groups have used their numerical and political power to suppress dissenting beliefs, persecute heretics, and impose their moral codes on non-believers.
   1. Mill argues that freedom of conscience must be absolute because allowing the majority to dictate religious belief destroys the very possibility of genuine faith.
2. The tyranny of the majority extends to lifestyle and personal conduct. Mill argues that democratic societies tend to enforce a narrow range of acceptable behaviours, punishing eccentricity, unconventional relationships, and minority cultural practices through informal sanctions.
   1. This connects to his defence of individuality (10.12.2): the pressure to conform stunts personal development and deprives society of the diversity it needs to progress.
3. Mill's analysis has implications for the structure of democratic institutions. He argues that democracies need constitutional protections for individual rights that cannot be overridden by majority vote.
   1. Bills of rights, independent judiciaries, and protections for minority groups all serve as institutional safeguards against the tyranny Mill describes.
4. The distinction between democracy and liberty is crucial for Mill. Democracy is a method of selecting governments; liberty is a substantive condition of individual freedom.
   1. The two can conflict when democratic majorities use their power to restrict the freedoms of individuals or minorities. Mill's liberalism insists that certain freedoms are prior to and independent of democratic decision-making.
