Mill's Arguments for Freedom of Expression

The Four Scenarios

1. John Stuart Mill devotes the longest chapter of On Liberty to defending freedom of thought and discussion. Building on the harm principle (10.12.1) and the value of individuality (10.12.2), Mill argues that free expression is the foundation on which all other freedoms depend.
   1. Without the ability to challenge established opinions, no belief can be held with rational confidence.
2. Mill's argument proceeds through four distinct scenarios. First, the suppressed opinion may be true, and silencing it deprives humanity of exchanging error for truth.
   1. Second, the suppressed opinion may be false, but open debate strengthens understanding of the true view.
   2. Third, each opinion may contain part of the truth, and free discussion combines them. Fourth, even a wholly true opinion that is never challenged degenerates into dead dogma.
3. The first scenario rests on the claim that no person or institution is infallible. Mill argues that history is littered with cases where the majority was wrong: Socrates was executed for impiety, Galileo was condemned by the Church, and countless dissenters were persecuted for views later recognised as correct.
   1. To suppress opinion is to assume an infallibility that no human authority possesses.

Infallibility, Dead Dogma, and Partial Truth

1. The second scenario introduces what has been called the dead dogma argument. Mill contends that a true opinion held without exposure to opposing arguments becomes mere prejudice, accepted on authority rather than understood through reason.
   1. If defenders of a view cannot articulate the case against it, they do not truly comprehend their own position. Free discussion is essential for genuine understanding.
2. Mill illustrates the dead dogma problem with Christian moral teaching. He argues that the ethical precepts of Christianity have lost much of their power because they are accepted as conventional formulas rather than living convictions tested against serious criticism.
   1. Beliefs not actively defended against challenge become hollow guides to conduct.
3. The third scenario, that conflicting opinions each contain partial truth, reflects Mill's epistemological humility (the honest recognition that our knowledge has limits and that we may be wrong). On most contested questions, no single perspective captures the full complexity.
   1. Only through free and open debate can partial truths in different positions be identified, combined, and refined into more adequate understanding.

Social Silencing and the Limits of Mill's Defence

1. Mill distinguishes between silencing through law and silencing through social pressure. He argues that both are equally harmful and that in democratic societies the latter is often more dangerous because it is more pervasive.
   1. The person whose livelihood depends on community approval may self-censor even without legal prohibition.
2. Mill's defence of free speech is not absolute. He acknowledges that expression can constitute direct incitement to harm, as when a speech to an angry mob outside a corn dealer's house provokes violence.
   1. The harm principle (10.12.1) sets the outer boundary: speech that directly causes definite harm to identifiable persons may be restricted.
3. The marketplace of ideas metaphor, though not Mill's own phrase, captures his core conviction. Just as a free market allocates resources more efficiently than central planning, a free marketplace of ideas produces better beliefs than censorship.
