Mill's Principle and Its Foundations

1. John Stuart Mill opens On Liberty by identifying the central question of political philosophy as the proper boundary between individual freedom and social authority. He argues that throughout history, the struggle for liberty has shifted from resisting tyrannical rulers to confronting a subtler danger: the tendency of democratic societies to impose conformity on individuals through social pressure and legal coercion.
2. Mill articulates his principle in what has become one of the most quoted passages in political philosophy: "The only purpose for which power can be rightfully exercised over any member of a civilised community, against his will, is to prevent harm to others." This harm principle establishes a clear and radical limit on the authority of both government and public opinion. It asserts that neither the state nor the collective has the right to interfere with conduct that affects only the individual concerned.
3. The harm principle rests on a distinction between self-regarding actions (those that affect only the individual) and other-regarding actions (those that affect other people).
   1. Mill argues that society has legitimate authority over other-regarding actions but no right to interfere with self-regarding conduct. An individual's own good, whether physical or moral, is not a sufficient warrant for compulsion.
4. Mill's argument is grounded in his utilitarian philosophy. He contends that human happiness is best promoted when individuals are free to pursue their own conceptions of the good life without interference.
   1. The aggregate utility (the total well-being of everyone in society, added together) of a society is maximised when its members have the widest possible scope for individual experimentation and self-development, subject only to the condition that they do not harm others.
5. Mill distinguishes his position from earlier liberal thinkers by grounding liberty not in natural rights but in utility in the largest sense.
6. He explicitly rejects appeals to abstract right as "independent of utility" and instead argues that freedom is valuable because it produces the greatest happiness for the greatest number. This utilitarian foundation gives the harm principle a consequentialist (judging an action right or wrong by its outcomes) rather than deontological (judging an action by rules or duties, regardless of its outcomes) justification.

The Concept of Harm and Its Scope

1. The concept of harm in Mill's usage is narrower than mere offence or disapproval. Harm involves a definite injury to another person's interests, particularly their rights and legitimate expectations.
2. Feeling shocked, disgusted, or morally outraged by another person's conduct does not constitute harm in Mill's sense. This distinction between harm and offence is critical to the principle's application.
3. Mill acknowledges that the harm principle applies only to persons in full possession of their faculties. Children and those who cannot care for themselves may legitimately be subject to paternalistic intervention.
4. He also limits the principle to "civilised" societies, a qualification that has been widely criticised for its paternalistic and Eurocentric implications.
5. The harm principle has both negative and positive dimensions. Negatively, it prohibits interference with self-regarding conduct.
6. Positively, it permits and even requires intervention when one person's actions threaten definite harm to others. Mill thus provides a framework for determining when state power is justified and when it constitutes an illegitimate intrusion into individual autonomy.
7. Mill's principle connects to earlier discussions of positive and negative liberty (7.3.2). The harm principle primarily protects negative liberty (freedom from interference), but Mill's broader argument in On Liberty also supports positive liberty by emphasising the conditions necessary for individual self-development and moral growth.

Applications and Implications of the Harm Principle
