Federal power: The New Deal transformed national government

The crisis weakened older limits

1. Federal responsibility had been narrower before 1933. States, municipalities, private charities, and markets handled much welfare and economic regulation.
2. The Depression overwhelmed local capacity. Falling tax revenue and mass unemployment left cities and states unable to meet demand.
3. Banking panic required national action. Only the federal government could close, inspect, and reopen banks across the country.
4. Economic collapse created public demand for visible leadership. Roosevelt presented federal experimentation as a practical response to emergency.
   1. The constitutional system remained intact. Expansion occurred through legislation, administration, elections, and judicial conflict rather than dictatorship.

The First Hundred Days concentrated initiative

1. Roosevelt entered office on 4 March 1933. Congress began an extraordinary session and passed major laws at rapid speed.
2. The Emergency Banking Act stabilized finance. It gave federal authorities power to inspect banks and permit sound institutions to reopen.
3. The Economy Act increased presidential control over spending. It allowed reductions in government salaries and veterans' payments despite political resistance.
   1. Relief and recovery agencies followed quickly. The CCC, FERA, AAA, TVA, and NIRA placed federal institutions inside everyday economic life.
   2. Congress delegated broad authority. Emergency conditions encouraged legislators to give the executive discretion over implementation.

The administrative state expanded

1. New agencies required federal experts and administrators. Economists, lawyers, engineers, social workers, and planners designed and enforced policy.
2. The Agricultural Adjustment Administration managed production. It paid farmers to reduce output in order to raise prices.
   1. The Tennessee Valley Authority combined development functions. A federal corporation built dams, generated electricity, controlled floods, and supported regional planning.
   2. The Securities and Exchange Commission regulated markets. Created in 1934, it required disclosure and policed securities trading.
   3. The National Labor Relations Board enforced labour rights. After 1935, it supervised union elections and investigated unfair labour practices.
   4. Federal administration became permanent. Many agencies changed names or ended, but regulation and professional bureaucracy remained central.

Relief connected citizens directly to Washington

1. FERA distributed federal relief funds to states. The national government financed aid while local bodies often administered it.
2. The Civilian Conservation Corps enrolled young men. Federal organization combined employment, conservation, military-style camps, and family remittances.
3. The Works Progress Administration became the largest employment programme. It funded roads, schools, parks, public buildings, art, theatre, music, and historical projects.
4. The federal government became an employer. Millions associated income and public works directly with national policy.
   1. Relief remained conditional and unequal. Race, gender, region, local administration, and occupational assumptions shaped access.

Federalism changed rather than disappeared

1. States continued to administer many programmes. The New Deal often used grants and shared responsibility rather than replacing state government.
2. Federal funding altered leverage. National money came with standards, reporting requirements, and policy priorities.
3. Regional inequality affected implementation. Poor states depended more heavily on Washington but also influenced programmes through local political power.
4. Southern officials preserved racial hierarchy. Local control allowed discriminatory wages, job assignments, and access.
   1. The result was cooperative federalism. Federal and state institutions became more interconnected, but rights still varied by place.

Roosevelt expanded presidential communication

1. Fireside chats used radio to address citizens directly. Roosevelt explained banking policy, legislation, and political conflict in accessible language.
2. Direct communication reduced dependence on hostile newspapers. The presidency gained a national audience beyond Congress and party organizations.
3. Press conferences became frequent. Roosevelt shaped the news cycle and presented the executive as continuously active.
4. The administration managed symbols of confidence. Public communication supported policy by encouraging deposits, spending, and political trust.
   1. Communication strengthened personal leadership. Critics feared that the presidency was becoming too dominant in public life.

The Second New Deal deepened federal responsibility

1. The Social Security Act of 1935 created national welfare institutions. Old-age pensions, unemployment insurance, and aid programmes established continuing federal obligations.
2. The Wagner Act protected collective bargaining. The federal government intervened directly in relations between employers and workers.
3. The Works Progress Administration expanded employment relief. Federal spending became a tool for sustaining demand and public infrastructure.
4. The Wealth Tax Act raised rates on high incomes and large firms. Roosevelt framed reform more openly around economic power.
   1. The Second New Deal moved beyond emergency stabilization. It created durable rights and institutions that survived the decade.

The Supreme Court imposed constitutional limits

1. The Court struck down the NIRA in Schechter Poultry v United States in 1935. The justices rejected broad federal regulation of intrastate business and excessive delegation.
2. United States v Butler invalidated the first AAA in 1936. The ruling challenged the use of federal taxation to control agricultural production.
3. Judicial decisions threatened central New Deal programmes. Roosevelt argued that constitutional interpretation had not adapted to national economic conditions.
   1. The conflict tested separation of powers. It showed that electoral mandates did not give the executive unlimited authority.
   2. Congress rewrote policies to survive review. The administration used new legislation as well as political pressure.

The court-packing plan exposed political limits

1. Roosevelt proposed judicial reorganization in February 1937. The bill allowed appointment of an additional justice for each sitting justice over the age of 70 who did not retire.
2. The proposal could have added six Supreme Court justices. Supporters called it administrative reform, while opponents saw an attempt to secure favourable rulings.
3. Democrats divided over the plan. Senators defended judicial independence and resisted presidential pressure.
4. The bill failed in Congress. Roosevelt's 1936 landslide did not guarantee control over his own party.
   1. The Court also shifted direction. Decisions in 1937 upheld minimum-wage and labour legislation, reducing immediate constitutional conflict.

Executive reorganization increased presidential capacity

1. The Brownlow Committee reported in 1937. It argued that the president needed a larger professional staff because modern responsibilities had outgrown existing arrangements.
2. The Reorganization Act passed in 1939. It allowed restructuring within the executive branch under congressional limits.
3. The Executive Office of the President was created. It gave the president stronger support for budgeting, planning, and coordination.
4. Institutional capacity outlasted Roosevelt. Later presidents inherited a larger staff and greater ability to supervise the bureaucracy.
   1. Expansion changed expectations. Citizens increasingly judged presidents by national economic performance.

Critics feared centralization and spending

1. Conservatives attacked the growth of bureaucracy. They argued that unelected agencies exercised powers that belonged to Congress or states.
2. Business groups opposed regulation and taxation. The American Liberty League presented the New Deal as a threat to property and constitutional government.
3. Populist critics demanded more federal action. Huey Long and Francis Townsend argued that Roosevelt had not redistributed enough wealth or security.
4. The left criticized state support for capitalism. Socialists and communists saw relief and regulation as stabilizing an unequal system.
   1. Opposition came from conflicting directions. The same expansion could appear excessive to conservatives and inadequate to radicals.

Federal capacity reached deeper institutional territory

1. The FDIC created a national promise to depositors. Federal deposit insurance reduced the danger of bank runs by protecting ordinary savings. This connected financial stability to a permanent national institution rather than local banking strength.
2. Social Security required federal-state administration. Old-age pensions operated nationally, while unemployment insurance depended on state systems shaped by federal incentives. The programme expanded federal responsibility without eliminating state government.
3. The Commerce Clause supported later reforms. After 1937, the Supreme Court interpreted federal power over interstate commerce more broadly. Constitutional change came through judicial doctrine as well as statutes and executive initiative.
4. Federal taxation gained a wider social role. Payroll taxes and progressive revenue measures funded national programmes and influenced economic behaviour. Tax collection became part of welfare administration and macroeconomic policy.

Historians debate the constitutional transformation

1. Liberal interpretations emphasize democratic rescue. They argue that federal action restored confidence and preserved constitutional government during mass crisis.
2. Conservative interpretations emphasize executive overreach. They point to delegation, spending, regulation, and the court plan as threats to limited government.
3. Institutional interpretations stress path dependence. Temporary emergency agencies created expertise and expectations that made federal expansion difficult to reverse.
4. Race and gender historians emphasize exclusions. Expanded power did not guarantee equal citizenship because programme design reflected southern and male-breadwinner assumptions.
   1. A strong judgement separates capacity from equality. The federal state became stronger, but its benefits and protections remained uneven.
