Occupation Zones and the Refugee Crisis

1. Germany and Austria's surrender was followed by occupation.
   1. Both countries were divided into zones administered by the Soviet Union, the United States, Britain, and France.
   2. The capital cities were split the same way.
2. The Allied Control Council replaced the Nazi government and took responsibility for administering the four zones.
3. Refugees flooded into the Allied zones.
   1. The camps were desperately overcrowded with displaced people from across Europe, all seeking help from the Allies and the aid agencies operating in the camps.

Categories of Displaced People

1. Displaced people fell into three broad categories.
   1. Internally displaced. People forced out of their homes by bombing, destruction of infrastructure, or Allied requisitioning.
   2. Liberated from camps. Survivors of forced labour, extermination and concentration camps, and Allied and German POWs.
   3. External refugees. People displaced by border adjustments and expulsions from Poland, Czechoslovakia, and the Baltic states fleeing communist regimes.

Why People Became Stateless

1. After the war, many displaced people became stateless.
   1. The reasons were tied directly to the war and its aftermath.
2. In some cases, the person's home country no longer existed or its borders had changed.
   1. This applied to people from former eastern Poland or the Baltic states.
3. In other cases, governments refused to recognize them, especially Jewish, Roma, or Sinti people and those who opposed pro-Soviet governments.
4. Some had no official documentation because it had been lost or destroyed during the war.
5. For Roma and Sinti people, the problem was older.
   1. Many had been marginalized and discriminated against for generations, had limited access to birth certificates, and could not prove citizenship.
   2. Statelessness was passed down through generations, as children of stateless parents found it even harder to register as legal citizens.

Choosing Statelessness Over Repatriation

1. Some refugees became stateless because they refused to be repatriated.
   1. In the initial days after the war, when the scale of the crisis was not yet understood, many displaced people were forcibly returned to their countries of origin.
   2. When they got there, they experienced violence or discrimination.
2. Rather than endure this, they returned to the DP camps.
3. The Kielce pogrom of 1946 illustrates this pattern.
   1. About 200 Jewish people returned to Kielce, a town in Poland.
   2. A false rumour spread that Jewish people had kidnapped or killed a Christian boy.
4. This triggered a violent attack on the Jewish community.
   1. At least 42 people were killed.
   2. The attackers included soldiers and policemen.
5. After Kielce, many Jewish people left Poland.
   1. Some went back to the DP camps, others emigrated to countries in the West, and some moved to British Mandatory Palestine.

The Right to Choose: Refoulement and the 1951 Convention

1. Over time, international organizations recognized the refugees' reasons for not wanting to return.
   1. These included the loss of homes and businesses, religious or ideological differences, and aggression from the people still living in their former communities.
2. The United Nations and the International Red Cross recognized that a person's right to choose their place of residence needed to be respected.
3. They concluded that forced deportations of asylum seekers amounted to refoulement and constituted a serious violation of the 1951 Refugee Convention.
4. But immediately after the war, the priority was to get as many people home as possible, as quickly as possible.
   1. The principle of non-refoulement was not initially followed.
5. Many DPs were forcibly repatriated before the international community recognized their right to refuse.

Classification and Documentation Shaped Refugee Status

1. Allied officials classified each displaced person before deciding what help they could receive. Registration cards recorded nationality, place of origin, wartime work, family links, and the possibility of return.
2. Documents could protect a claim, but many survivors had lost passports, birth certificates, and property records during deportation or flight. Officials then relied on testimony, camp records, and interviews that could be inconsistent or shaped by fear.
3. A classification was not neutral. It could determine access to food, housing, legal protection, repatriation, or resettlement, and the same person might be described as a refugee, displaced person, returnee, or illegal migrant by different authorities.

The Harrison Report Changed the Treatment of Jewish Displaced Persons

1. In August 1945, Earl G. Harrison inspected DP camps for the United States government and reported that Jewish survivors were still living in poor conditions, sometimes alongside people who had persecuted them.
2. Harrison recommended separate facilities and recognition of Jewish survivors as a distinct group. His report challenged the Allied practice of treating all displaced people mainly by pre-war nationality.
3. President Harry S. Truman pressed occupation authorities to improve food, housing, and migration arrangements. Conditions did not change at once, but the report made persecution and group identity more important in refugee policy.

Cold War Politics Changed the Meaning of Return

1. At first, Allied policy treated repatriation as the normal solution. This became harder when people from Poland, the Baltic states, Ukraine, and other Soviet-controlled areas said that return could lead to arrest, forced labour, or political persecution.
2. Western governments increasingly accepted refusal to return as a political claim. From 1947, the International Refugee Organization screened applicants and supported resettlement for many people who rejected repatriation to communist states.
3. This shift protected some refugees, but it also favoured people who could be presented as politically reliable and employable. Suspected collaborators, people with serious illnesses, and those without clear documentation often faced exclusion or long delays.

Resettlement Offered Safety but Created New Inequalities

1. The United States, Canada, Australia, Britain, and other states admitted large numbers of European refugees through labour and migration schemes. Selection rules often favoured young, healthy workers and families considered easy to integrate.
2. Older people, disabled survivors, people with tuberculosis, and families without a principal wage earner could remain in camps long after others departed. Admission policy therefore shaped how long displacement lasted.
3. Resettlement ended camp life but not the experience of displacement. Refugees had to learn new languages, find work, rebuild family networks, and live with the loss of homes, citizenship, and relatives.
