Experiences of Women: Legal Equality, Uneven Reality

Women's Status Before 1949

1. Historically, Chinese women had been among the most repressed in the world, living within a patriarchal society shaped by Confucian ideals that held a woman must obey her husband.
2. It was very rare for a woman, such as the Empress Dowager Cixi, to hold real political power.
3. The medieval practice of footbinding was still carried out in some parts of China, and in rural areas it remained commonplace for women to be forced into arranged marriages.
4. Many women were effectively sold into marriage at a price based on how many children she was likely to bear.
5. Before the establishment of the People's Republic, it was legal and unremarkable for a husband to keep concubines, meaning even a married woman remained subordinate within her own household.

Mao's Early Statements on Women's Rights

1. As early as 1919 Mao wrote a series of articles condemning arranged marriage, and through the 1930s and 1940s he continued to present himself as a firm believer in women's rights.
2. The Party outlawed footbinding in the parts of China where it still survived by the time of the revolution.
3. Even so, a married woman's legal status remained unequal within the relationship as long as her husband could keep concubines.
4. Concubines themselves held less status than wives, since they were not formally married yet were still expected to defer to the needs of the man in the relationship.
5. These early statements set genuine expectations for reform that the new regime would be judged against once it held power.

The Marriage Reform Law, 1950

1. In 1950 the PRC introduced the Marriage Reform Law, which abolished concubinage, ended arranged and child marriages, forbade the paying of dowries, and permitted divorce for men and women who had previously been forced to marry, while requiring all marriages to be registered with the state.
2. The new marriage reforms were received with genuine enthusiasm, and many women divorced, and often remarried, in the years immediately following the law.
3. Urban, educated women benefited most from these reforms, since they were more likely to have independent income or family support to fall back on.
4. Many rural women, by contrast, lacked independent income or land of their own, meaning divorce could mean severe poverty despite their new legal equality.
5. By the mid-1950s the CCP had grown concerned about the social unrest caused by the spike in divorces, and began promoting marital harmony over the individual freedoms the 1950 law had just granted.

Land Redistribution and Its Limits for Women

1. During the land redistribution campaigns of the early 1950s, many women initially benefited from Mao's land reforms, being granted land registered in their own name for the first time.
2. This was a significant break with tradition, under which only men had ever controlled property within a Chinese household.
3. These individual gains proved short-lived, however, because the later collectivisation of agriculture removed the right of both men and women to own land privately at all.
4. Women's formal equality in landownership therefore existed only briefly, in the narrow window between the 1950 reforms and full collectivisation later in the decade.

Women in the Workforce

1. In the 1950s Mao popularised the slogan Women hold up half the sky, projecting an image of gender equality in productive labour.
2. In practice the People's Republic remained a heavily male-dominated system, with few important Party posts going to women even as female participation in the workforce expanded.
3. Female comrades who took on paid work were still generally expected to carry out domestic chores at home as well, leaving them with a double burden their male colleagues did not share.
4. The number of working women quadrupled between 1949 and 1976, rising from around 8 percent to around 32 percent of the workforce.
5. For many women this expansion into paid work was a real gain, but others found themselves poorly suited to the heavy physical labour many jobs demanded and felt no better off for the change.

Persistent Inequality Within a Formally Equal System

1. It proved difficult to challenge deeply ingrained ideas about women's role even under a regime formally committed to equality.
2. Female infanticide continued in many areas, since most Chinese couples believed sons brought honour and future economic support while daughters represented a drain on resources through dowries and lost future income.
3. In Xinjiang, the official notion of female equality was not well received, since local cultural norms there dictated that women remain obedient to male relatives and largely confined to domestic work.
4. Women made up only around 13 percent of Chinese Communist Party membership under Mao's rule.
5. The share of women deputies in the National People's Congress rose from around 14 percent to around 23 percent, a modest increase that gives little sign the Party was making sustained efforts to bring women into politics.

Collectivisation and the Attack on the Family

1. Collectivisation was never only about state control of land: it also amounted to a deliberate attack on the autonomy of the traditional Chinese family.
2. Forcing private family groups together into large collective farms undermined family structure, and Mao himself argued that dismantling the family was necessary for the good of the state.
3. From 1958, people's communes went further still, attempting to socialise childcare, cooking, and other domestic work through communal nurseries and dining halls.
4. Children were told to refer to Chairman Mao as their father and to place personal loyalty to the Party above love for their own parents.
5. In many communes married couples were kept apart and permitted to see each other only for scheduled conjugal visits, reducing marriage itself to a state-managed arrangement.
6. Many women who had previously defined themselves through their roles as wives and mothers saw those roles become effectively redundant under this system.

Women and the Great Leap Forward Famine

1. Women suffered acutely during the Great Leap Forward famine as they struggled to provide for their children with almost no food available.
2. Many mothers faced the agonising choice of deciding which child would go without food so that the rest of the family might survive.
3. In some cases it improved a woman's odds of survival to divorce her husband and seek a new marriage elsewhere, and divorce rates rose sharply in the famine-struck provinces for exactly this reason.
4. Many children were left motherless as a result and ended up abandoned, a pattern that affected girls first and then, as the famine deepened, boys as well.
5. These abandoned and vulnerable children became targets for exploitation by local CCP officials, and sex work increased as desperate women sought any way to obtain food, with officials in some areas even running brothels for private Party use.

The Cultural Revolution and the Family

1. During the Cultural Revolution the traditional nuclear family itself was attacked as one of the Four Olds.
2. Under the banner of the Red Guards, ordinary everyday family life was denounced and, in many households, actively destroyed as children were encouraged to inform on or renounce their own parents.
3. This period placed women in an especially difficult position, expected simultaneously to be loyal revolutionary citizens and to maintain a family life the state now treated with open suspicion.
4. Although China's population almost doubled over the course of Mao's rule, later leaders, moving away from Mao's pronatalist instincts, introduced strict measures to restrict the number of births.

Historiography: Liberation or Instrumentalisation?

Comparing Women's Experiences Across Case Studies

1. Mao's mixture of formal legal equality alongside persistent practical inequality for women recurs, in different forms, across this unit's case studies.
2. Castro's Cuba similarly granted women formal legal equality and high workforce participation through bodies such as the Federation of Cuban Women, while political leadership remained heavily male-dominated in much the same way as in Mao's China.
3. Nasser's Egypt granted Egyptian women the vote under the 1956 constitution, with rising education access reinforced by the 1962 National Charter, yet, like Mao's China, saw little change in women's representation at the top of the Party or state apparatus.
4. For a Section B(b) essay on the experiences of women, pairing Mao's Marriage Reform Law with either Castro's Federation of Cuban Women or Nasser's National Charter shows a common authoritarian pattern of granting legal rights from above while limiting genuine political power.

Women in CCP Leadership: Named Exceptions

1. A small number of women did rise to real prominence within the Party under Mao, most visibly his own wife Jiang Qing, who used her position during the Cultural Revolution to control cultural policy as a member of the Gang of Four.
2. He Xiangning and Cai Chang were among the few women who held senior formal roles in the CCP and the All-China Women's Federation from the 1950s onward, promoting the regime's official women's policies.
3. These prominent exceptions did not translate into broader female representation in the Party, and Jiang Qing's own downfall and arrest in 1976 shows how precarious even the highest female political position in Mao's China could be.
4. Rather than proving that women could rise purely on merit, the small number of visible women leaders mostly depended on close personal ties to Mao himself, reinforcing rather than challenging the male-dominated structure beneath them.

Health, Reproduction, and the State

1. Maternal and infant healthcare improved significantly under Mao's patriotic health movements, extending basic medical provision to rural women who had previously had almost no access to trained care during childbirth.
2. At the same time, the state took an increasingly direct interest in reproduction, and the later trend toward restricting family size under Mao's successors had its roots in this same pattern of treating reproduction as a matter of national policy rather than private choice.
3. During the Cultural Revolution, doctors fearful of appearing bourgeois sometimes withheld anaesthetics and pain relief during childbirth, meaning gains in medical access did not always translate into humane treatment for women giving birth.
4. This combination of expanded access alongside politically driven restrictions on care shows how women's health under Mao cannot be reduced to a simple story of either progress or repression.

Domestic Violence and the Limits of Legal Reform

1. Although the 1950 Marriage Reform Law gave women new legal grounds for divorce, it did little to directly address domestic violence within marriage, which remained a largely private matter outside significant state intervention.
2. Rural cadres tasked with enforcing the new marriage law were themselves often products of the same patriarchal culture the law aimed to change, and enforcement varied considerably from region to region.
3. This gap between a progressive law on paper and inconsistent enforcement on the ground is a common pattern in how authoritarian regimes deliver social reform, promising more than local officials are willing or able to carry out.
