Legal Change: Legislation and Litigation in the Chicano Movement

1. Legal change was one of the most concrete achievements of the Chicano movement, pursued through two main channels: labor law and contracts won by the UFW, and civil rights litigation brought by MALDEF and other legal organizations challenging discrimination in education, voting, and employment.

1. The California Agricultural Labor Relations Act (ALRA) of 1975 was the clearest legislative victory for farm workers. It gave California agricultural workers the right to organize unions and bargain collectively, rights that the National Labor Relations Act of 1935 had explicitly excluded for farm workers. The ALRA was won after years of strikes, boycotts, and lobbying by the UFW under Governor Jerry Brown.

1. Before the ALRA, UFW contracts were the primary legal protection for farm workers. The Delano grape growers' contract of 1970 ended the five-year strike and boycott, securing wage increases (from $1.25 to $1.80 per hour), rest breaks, drinking water in the fields, portable toilets, and restrictions on pesticide exposure. These were the first health and safety regulations covering California farm workers.

1. The Treaty of Guadalupe Hidalgo created foundational claims. Its citizenship and property provisions became a reference point for activists challenging land loss and unequal incorporation after 1848.
2. Courts often failed to protect treaty rights. Lengthy procedures, legal cost, taxes, fraud, and narrow interpretation helped transfer land despite formal guarantees.
3. In re Rodriguez addressed racial citizenship. An 1897 federal court recognized a Mexican immigrant as eligible for naturalization, classifying Mexicans as white for legal purposes.
4. Legal whiteness did not prevent segregation. Schools, housing, employment, policing, and public facilities continued to impose racial discrimination through local practice.
5. Independent School District v Salvatierra allowed separation. The 1930 Texas decision accepted segregating Mexican-origin pupils for language reasons, enabling districts to disguise racial policy.
6. Alvarez v Lemon Grove stopped one school plan. In 1931, a California court blocked a separate school, though its local effect did not end wider segregation.
7. Mendez v Westminster transformed educational law. The 1946 federal case ruled against separate Mexican schools in Orange County districts.
8. The Mendez plaintiffs documented arbitrary classification. Children were separated by surnames and appearance even when they spoke English, exposing the weakness of language justifications.
9. The appellate ruling emphasized equal state law. It did not directly overturn Plessy nationally but contributed reasoning and momentum toward broader school desegregation.
10. California repealed segregation statutes in 1947. Governor Earl Warren signed legislation ending remaining legal authority for separate schools.
11. Hernandez v Texas expanded equal protection. The 1954 Supreme Court ruled that the Fourteenth Amendment protected groups beyond a Black-white binary.
12. Jury exclusion supplied concrete evidence. No person with a Mexican surname had served on a Jackson County jury commission or jury for many years.
13. The Hernandez decision recognized community discrimination. The Court examined social treatment and local institutions rather than accepting formal classification as white.
14. Delgado v Bastrop challenged Texas schools. A 1948 federal ruling prohibited routine segregation of Mexican American children while allowing limited language instruction.
15. Cisneros v Corpus Christi addressed de facto segregation. In 1970, a federal court recognized Mexican Americans as an identifiable minority entitled to desegregation protection.
16. Keyes v School District No. 1 reached western cities. The 1973 Supreme Court case treated intentional segregation of Black and Latino students in Denver as unconstitutional.
17. Lau v Nichols changed language-access law. In 1974, the Court ruled that identical instruction could deny meaningful education to students unable to understand English.
18. The Bilingual Education Act funded new programmes. Title VII of the 1968 Elementary and Secondary Education Act supported instruction for limited-English-proficient students.
19. Serna v Portales strengthened bilingual remedies. The 1974 decision required a New Mexico district to address language barriers under federal civil-rights law.
20. The Voting Rights Act created new tools. Its protections and later extensions supported registration, challenges to discrimination, and federal oversight.

28. California filled part of that gap in 1975. The Agricultural Labor Relations Act created secret-ballot elections and collective-bargaining procedures for farmworkers.
29. The law institutionalized movement gains. The UFW could seek certified representation, though enforcement, rival unions, employer resistance, and later politics limited results.
30. Plyler v Doe protected undocumented children. In 1982, the Supreme Court struck down a Texas policy denying free public education based on immigration status.
31. The decision recognized severe social costs. The Court held that creating an uneducated underclass required more justification than the state provided.
32. Immigration law also produced exclusion. The 1952 and 1965 acts, border enforcement, raids, detention, and deportation shaped rights differently for citizens and noncitizens.
33. Operation Wetback demonstrated weak due process. The 1954 campaign removed people through racial profiling and coercive procedures that also harmed citizens and lawful residents.
34. Housing law offered incomplete protection. The Fair Housing Act prohibited discrimination, but weak early enforcement allowed steering, redlining, and lending inequality to continue.
35. Affirmative action expanded educational access. Universities developed recruitment and admission programmes while facing legal challenges over race and ethnicity.
36. Regents v Bakke limited quotas but preserved consideration. The 1978 decision rejected a fixed set-aside while allowing race to be one factor in admissions.
37. Police accountability remained legally difficult. Qualified immunity, prosecutorial discretion, local control, weak civilian review, and fear of retaliation constrained remedies for abuse.
38. Legal victories required community enforcement. Parents, workers, voters, plaintiffs, lawyers, organizations, and elected officials had to monitor compliance after judgment or legislation.
39. The central outcome was expanded legal recognition. Courts and statutes acknowledged Mexican Americans and language minorities, yet citizenship, geography, immigration status, and enforcement continued to produce unequal rights.

Evidence for judging legal change

1. Filipino workers led by Larry Itliong began the Delano grape strike in September 1965.
