Legal Methods: Dictatorship Through the Constitution

Machtergreifung: Hope, Not Yet Reality

1. Nazis used the term Machtergreifung, seizure of power, to describe Hitler's appointment as Chancellor in January 1933, but as historian Roger Eatwell has observed, at first this was more a statement of hope than a description of political reality.
2. From January 1933 to August 1934, Hitler worked systematically to convert his position as head of a coalition cabinet into one of complete personal control.
3. He eliminated obstacles to Nazi rule through a combination of intimidation and bribery rather than through a single dramatic act.
4. Both the traditional political elite, who believed they could control him, and the left-wing opposition, badly weakened by earlier defeats, failed to stop this gradual process.

The March 1933 Election

1. Hitler called new elections for March 1933 to improve on the Nazi Party's declining seat count from November 1932, now with the advantage of already holding the Chancellorship.
2. Hermann Göring controlled the Prussian Ministry of the Interior, by far Germany's largest state, while Wilhelm Frick served as National Minister of the Interior, giving the Nazis direct control over policing during the campaign.
3. SA brownshirts attacked KPD and SPD paramilitaries, Reichstag deputies, and party offices in the weeks around the election, a breakdown of order Hitler then used to justify further emergency measures.
4. Even so, the NSDAP gained only 288 of 647 seats, 43.9 percent, still short of an outright majority despite the propaganda campaign and anti-communist frenzy that followed the Reichstag Fire.

Excluding the Communists

1. The KPD, whose leaders had already been arrested following the Reichstag Fire, was treated as a forbidden organisation even though its candidates' names had not been removed from the ballot.
2. The party still won 81 seats in the March 1933 election, but none of its deputies were permitted to actually sit in parliament or vote on legislation.
3. This selective exclusion let Hitler claim a formal electoral mandate while simultaneously eliminating the one party bloc most likely to vote against his further plans.
4. Historian Richard Evans has noted that even at this stage nearly two-thirds of German voters had lent their support to parties, Nazi, nationalist, or communist, that were open enemies of Weimar democracy.

The Enabling Act, March 1933

1. Hitler introduced an Enabling Bill that would let him rule by decree for four years, effectively making him dictator while retaining a legal, constitutional appearance.
2. His coalition with the DNVP gave him only a 52 percent majority, well short of the two-thirds supermajority the bill legally required to pass.
3. He reached that threshold by simply excluding the KPD's 81 seats from the count, intimidating many SPD deputies into staying away from the vote, and offering the Centre Party and BVP guarantees protecting Catholic Church rights in exchange for support.
4. The Enabling Act passed by 444 votes to 94 on 23 March 1933, with every party except the SPD voting in favour.

Otto Wels and the Last Defence of Democracy

1. SPD leader Otto Wels spoke out publicly against the Enabling Bill, the only party leader to do so in the Reichstag chamber that day.
2. Wels reportedly attended the vote carrying a concealed cyanide capsule, prepared for the possibility of arrest and torture as a consequence of his opposition.
3. This single detail illustrates how thoroughly German parliamentary life had already been brutalised by the spring of 1933.
4. President Hindenburg signed the Enabling Act into law, effectively transferring his own constitutional powers to the Chancellor he had appointed only weeks earlier.

Gleichschaltung: Coordinating Every Institution

1. The passing of the Enabling Act in March 1933 opened the door to a wave of new laws implementing Gleichschaltung, the forced coordination of German institutions with Nazi ideology.
2. The Enabling Act alone did not guarantee every institution's loyalty, so the churches, the military, the labour movement, and the civil service all had to be individually brought under control.
3. This institution-by-institution process shows that Nazi consolidation of power was methodical and sustained over many months, not accomplished in a single legal stroke.

Purging the Civil Service

1. The Law for the Re-establishment of the Civil Service, passed in April 1933, allowed the government to remove officials it considered anti-Nazi.
2. The law specifically ordered the dismissal of officials not of Aryan descent, as well as officials whose political record offered no guarantee they would support the national state without reservation.
3. This purge removed opponents of National Socialism and people of Jewish descent from the judiciary, diplomacy, and education simultaneously.
4. The cleansing also let the regime reward the Alte Kämpfer, its earliest loyal members who had joined before September 1930, while absorbing so-called March Violets, opportunists who joined only after March 1933 to advance their careers.

Destroying Trade Unions and Political Parties

1. In May 1933 all trade unions were abolished and replaced by the Nazi-run German Labour Front, ending collective bargaining and the right to strike entirely.
2. Hitler presented this as restoring social peace in the world of labour, replacing discord with the harmony of the people's community.
3. By July 1933 every political party except the NSDAP had been formally abolished, technically establishing Germany as a single-party state.
4. The Centre Party and BVP voluntarily dissolved on 5 July 1933, in the expectation of a Concordat between the Nazi government and the Vatican protecting the institutional position of the Catholic Church.

Historiography: Machtergreifung as Event or Process?

Comparing Legal Consolidation Across Case Studies

1. Hitler's careful use of formally legal mechanisms to dismantle democracy recurs, in different forms, across this unit's case studies.
2. Nasser's regime dissolved all Egyptian political parties by January 1953 through decree rather than through an equivalent parliamentary vote like the Enabling Act.
3. Castro suspended elections and built a one-party state through a dual-power shadow government structure rather than through formal legislative votes at all.

The Reichstag Fire Decree

1. On 28 February 1933, the day after the Reichstag fire, Hindenburg signed the Decree for the Protection of the People and the State, invoking Article 48's emergency powers.
2. The decree suspended core civil liberties, including habeas corpus, freedom of the press, and freedom of assembly, indefinitely rather than temporarily.
3. This single decree remained legally in force throughout the entire Third Reich, technically serving as one of the central legal foundations of Nazi rule right up to 1945.
4. Framing the suspension of rights as a temporary emergency response to a communist threat gave the decree a legal legitimacy that a more openly permanent measure might not have secured so easily.

Preventive Detention and Protective Custody

1. The Reichstag Fire Decree allowed the state to hold people in indefinite protective custody, Schutzhaft, without charge or trial.
2. This legal mechanism was used to imprison political opponents, particularly communists and socialists, in newly established camps from 1933 onward.
3. Framing extrajudicial detention as protective custody gave what was, in practice, arbitrary imprisonment a veneer of legal process.
4. This tool became one of the regime's most important instruments for removing opponents without the delay, publicity, or uncertainty of an actual criminal trial.

The Concordat With the Vatican, July 1933

1. In July 1933 the Nazi government signed a formal Concordat, a treaty with the Holy See, guaranteeing the Catholic Church's institutional rights, schools, and property within Germany.
2. In exchange, the Church agreed that its clergy would stay out of political activity, removing one of the few remaining organised institutions capable of coordinated opposition.
3. This agreement echoed Mussolini's earlier 1929 Lateran Treaty with the Vatican, and gave Hitler important international legitimacy only months into his rule.
4. The Concordat shows how legal agreements with respected international institutions could serve Nazi consolidation just as effectively as domestic legislation.

Hindenburg's Death and the Führer Title, August 1934

1. President Hindenburg died on 2 August 1934, but Hitler had already secured a law merging the offices of president and chancellor in anticipation of this moment.
2. Upon Hindenburg's death Hitler assumed the combined title of Führer und Reichskanzler, formally uniting head of state and head of government in a single person.
3. The German army swore a new personal oath of loyalty to Hitler as Führer rather than to the constitution or the German state itself, a change with enormous long-term significance for military obedience even after the regime's worst crimes became apparent.
4. A plebiscite held later that August claimed around 90 percent approval for merging the two offices, giving the change a claimed popular mandate.
5. This step, more than almost any other, completed the legal transformation of Hitler's position from an elected Chancellor into an unaccountable head of state commanding personal military loyalty.

Reich Governors and the End of German Federalism

1. Reich Governors, or Reichsstatthalter, were appointed to override the authority of Germany's individual state governments.
2. This appointment effectively ended Germany's traditional federal structure, in which the states had held considerable independent authority.
3. All meaningful administrative power was centralised in Berlin, removing another potential source of institutional resistance to Nazi policy.

Legal Continuity as Camouflage

1. Hitler largely retained Germany's existing courts, civil service, and administrative bureaucracy rather than replacing them outright with entirely new Nazi institutions.
2. This continuity gave the regime an outward appearance of legal normality that helped secure both domestic compliance and a degree of early international respectability.
3. Ordinary Germans continuing to deal with familiar courts, familiar officials, and familiar bureaucratic procedures made the underlying transformation of the state feel less abrupt than it actually was.
