Mao’s Legal Framework and Constitution
After 1949, Mao introduced a legal structure that gave the Communist Party full control while appearing to follow constitutional rules.
The Common Program of 1949 acted as a temporary constitution and allowed the CCP to dominate government, education, and the military through legal means.
The 1954 Constitution formally established China as a one-party socialist state, giving the CCP legal dominance and Mao supreme authority.
These documents claimed to protect freedoms but were written in a way that ensured loyalty to the CCP was the top legal priority.
Control Through 'Democratic' Structures
Mao claimed there were elections for government positions, but all officials were hand-picked and remained personally loyal to Mao.
The appearance of local representation masked the reality that no political competition or independent opposition was legally permitted.
China was divided into six regions, each with a Military Commander and a Political Commissar, both drawn from the PLA.
This setup gave Mao military and political control over every region, regardless of who held the title of Chairman or civil leader.
