Women in Tunisia: From State Feminism to Constitutional Equality

1. Tunisia entered its revolution with the most progressive women's rights legislation in the Arab world, and the years that followed tested whether that legal legacy would deepen into genuine equality or remain a symbol used by successive regimes.

Tunisia's Feminist Tradition

1. Tunisia entered the post-independence era with one of the most progressive legal frameworks for women in the Arab world.
   1. In 1956, President Habib Bourguiba introduced the Personal Status Code (PSC), a landmark set of reforms that fundamentally altered the legal position of women in Tunisian society.

1. The PSC abolished polygamy, gave women equal rights to divorce, set a minimum marriage age, and required the consent of both parties to marry.
   1. These were radical departures from the norms of neighbouring Arab states.
   2. Further reforms in 1993 strengthened mothers' rights, expanding custody and guardianship provisions that the original PSC had left favouring fathers.
2. Tunisian women had been organising well before independence.
   1. Bchira Ben Mrad founded the Muslim Union of Tunisian Women in 1936, making her one of the earliest organised voices for women's rights in the country.
3. Tawhida Ben Cheikh became the first Muslim woman in North Africa to earn a university degree in medicine.
   1. She later supported the legalisation of abortion in 1973, reflecting how Tunisian women were active participants in shaping social policy, not just passive recipients of reform.
4. Radhia Haddad led the National Union of Tunisian Women (UNFT), further cementing women's organised presence in public life.
   1. By the late twentieth century, Tunisia's reputation as the most progressive Arab country on women's rights was well established.

State Feminism Under Ben Ali

1. When Zine El Abidine Ben Ali took power in 1987, his government continued to promote women's rights, but largely as a tool of political legitimacy.
   1. Scholars use the term "state feminism" to describe this approach.
   2. The regime publicly championed gender equality while using it to deflect criticism of its authoritarian rule.
2. Under Ben Ali, women held 29% of parliamentary seats through a quota system.
   1. Two key feminist organisations, the ATFD (Tunisian Association of Democratic Women) and the AFTURD (Tunisian Association of Women for Development and Research), were officially recognised.
3. Recognition did not mean freedom, though.
   1. Civil society organisations operated under tight state control, and real political power remained almost entirely in male hands.
   2. Women's rights statistics served as a showcase for international audiences rather than a reflection of genuine political equality.

Women in the Revolution

1. Women were visible and active participants in the 2010-2011 revolution.
   1. They joined street protests, coordinated logistical support for demonstrations, and used digital platforms to spread information about events on the ground.
2. Lina Ben Mhenni is one of the most prominent examples.
   1. A blogger and activist, she documented the protests in real time, bringing international attention to events the Ben Ali government was trying to suppress.
   2. Her blog became a key source for journalists and foreign observers.
3. The revolution opened space for civil society to expand rapidly.
   1. Around 300 new women's organisations were founded in 2011 alone.
   2. This surge reflected both the energy of the revolutionary moment and the decades of suppressed organising that preceded it.

Constitutional Gains and the Article 28 Battle

1. The post-revolution period produced concrete legal advances for women, but not without significant political struggle.
   1. An early victory came with Decree Law 2011-35, which introduced a vertical parity requirement for electoral lists.
   2. Parties had to alternate male and female candidates, ensuring women would appear throughout the list and not just at the bottom.
2. In the 2011 National Constituent Assembly (NCA) elections, 59 women were elected (27%).
   1. That figure rose to 67 women (31%) after some male members stepped down and were replaced by women from lower positions on the same party lists.

1. The 2014 Constitution was the central legislative outcome of this period for women's rights.
   1. Four key articles are worth knowing:
   2. Article 21: equality before the law for all citizens, regardless of sex.
   3. Article 34: the state guarantees women's right to political participation.
   4. Article 46: the state commits to protecting women from violence.
   5. Article 40: the right to work under decent conditions and fair pay is guaranteed.

Persistent Inequalities

1. Inheritance law remained a significant area of legal discrimination.
   1. Under traditional interpretations of Islamic inheritance rules, which Tunisian law largely preserved, daughters inherited half the share of sons.
   2. Feminist groups pushed for reform and called on the government to lift Tunisia's reservations on CEDAW (the Convention on the Elimination of All Forms of Discrimination Against Women), which Tunisia had ratified in 1985 with reservations that limited its application to family and inheritance law.
2. Economic participation told a similar story.
   1. Only 24% of Tunisian women participated in the formal workforce, one of the lowest rates in the region despite the country's comparatively advanced legal framework.
   2. Private sector inequalities in pay and promotion persisted, and social attitudes in many communities did not shift at the same pace as legislation.
3. Citizenship laws also contained discriminatory provisions.
   1. In some cases, children of Tunisian mothers and foreign fathers faced restrictions that children of Tunisian fathers did not.
   2. This pointed to the limits of constitutional guarantees when secondary legislation was not reformed to match.

Law and Lived Equality

1. The 2014 Constitution protected equality and committed the state to women's representation, but implementation depended on later laws and enforcement.
2. Inheritance and employment inequality showed that constitutional rights did not automatically remove unequal family law, pay gaps, or regional barriers.
