EU Expansion After 1990: Reuniting Europe and Testing the Union

Why enlargement became possible

1. The end of the Cold War: the collapse of communist rule in 1989 and the breakup of the Soviet bloc made EU membership possible for Central and Eastern European states.
   • For Poland, Hungary, Czechoslovakia, and the Baltic states, joining Western institutions meant escaping the political category of the Soviet East. Return to Europe became a common phrase.
   • For existing EU members, enlargement promised stability on the union’s eastern border after decades of division. Security and economics worked together.
2. Identity and belonging: membership symbolised recognition as democratic, European, and no longer under Moscow’s shadow.
   • This mattered because post-communist governments wanted investment and market access, but they also wanted a public break with 1945.
   • The EU offered a civilian route to security, while NATO offered the military route.
3. The Maastricht context: the Maastricht Treaty of 1992 created the European Union and set a deeper integration agenda just as eastern applicants were preparing reforms.
   • The EU was therefore expanding while also changing itself through monetary union, citizenship, and greater policy coordination. Widening and deepening happened together.
   • This dual process created tension because a larger EU became harder to govern through institutions designed for a smaller community. Institutional strain was built in early.

The Copenhagen Criteria and accession process

1. The Copenhagen Criteria: in 1993, the EU set three main conditions for applicants: stable democracy, a functioning market economy, and capacity to apply EU law.

• Applicants had to protect minority rights, build independent courts, liberalise markets, privatise state firms, and adopt the acquis communautaire. Conditionality turned membership into a reform lever.
• The promise of membership gave the EU far more influence before accession than after accession. Leverage depended on the prize still being withheld.

1. Economic transition: candidate states moved from planned economies toward market economies, often through privatisation, price liberalisation, and foreign investment.
   • The process created growth and modernisation, but it also caused unemployment, inequality, corruption, and resentment toward foreign ownership. Transition costs shaped later politics.
   • EU funds and market access helped soften some costs, but reforms were still socially uneven. Winners and losers emerged quickly.
2. Legal harmonisation: applicants had to adopt thousands of pages of EU rules before joining.
   • This included competition law, environmental standards, food safety, border controls, procurement rules, and judicial procedures. Administrative capacity became part of democracy-building.
   • Critics argued that the process often rewarded formal compliance more than deep democratic culture. Paper reform could hide weak institutions.

The 2004 enlargement

1. Ten states joined in 2004: Cyprus, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, and Slovenia entered the EU on 1 May 2004.
   • Eight of the ten were former communist states or former Soviet republics, which made enlargement a direct consequence of the Cold War’s end. Eastern enlargement reshaped the map.
   • The EU gained about 75 million citizens, making it the largest enlargement in the union’s history.
2. Economic effects: new members received access to the single market, structural funds, agricultural payments, and foreign investment.
   • Poland and the Baltic states used EU membership to attract investment and expand exports. Growth strengthened the appeal of accession.
   • Older members gained new markets and labour supply, but also faced domestic fears about wage competition and welfare pressure. Integration created distributional conflict.
3. Freedom of movement: EU citizenship allowed workers from new member states to move to existing member states, though many governments used temporary restrictions.
   • Britain, Ireland, and Sweden opened their labour markets immediately, which produced larger migration flows than many officials expected. Labour mobility became politically sensitive.
   • Polish migration to Britain became one of the most visible social consequences of enlargement. Everyday Europe appeared in workplaces, schools, and towns.

Later enlargement and borders

1. Bulgaria and Romania in 2007: these accessions extended the EU farther southeast but raised stronger concerns about corruption, judicial independence, and administrative capacity.
   • The EU used monitoring mechanisms after accession, showing that conditionality had not fully solved institutional weakness before membership. Post-accession monitoring became necessary.
   • The cases showed the tension between geopolitical inclusion and strict enforcement of standards. Expansion logic often pushed faster than institutional confidence.
2. Croatia in 2013: Croatia joined after years of post-Yugoslav reconstruction, cooperation with war-crimes tribunals, and reform of state institutions.
   • Its accession showed that EU enlargement also functioned as a peace-building tool after the Yugoslav wars. Stabilisation was part of the enlargement project.
   • It also showed that later accessions became slower and more demanding than the 2004 round. Enlargement fatigue increased.
3. Turkey and the Western Balkans: Turkey’s accession talks stalled, while Western Balkan states faced slow progress because of governance problems, nationalism, and EU hesitation.
   • These cases revealed that the EU’s promise of membership remained powerful but less certain than in the 1990s.
   • The longer accession process reduced the reform leverage that had worked more strongly before 2004. Credibility mattered.

Sovereignty and enlargement fatigue

1. Existing member concerns: as the EU grew, voters and governments in older member states questioned whether enlargement had moved faster than public consent.
   • Concerns focused on migration, wage competition, budget contributions, agricultural spending, and the loss of national control. Sovereignty became a sharper public issue.
   • These concerns did not mean enlargement failed, but they changed its political meaning after 2004.
2. New member concerns: some citizens in Central and Eastern Europe saw EU rules as a new form of external pressure after decades of Soviet control.
   • Nationalist leaders used this memory to argue that Brussels was replacing Moscow as an outside authority. Historical memory shaped Euroscepticism.
   • This comparison was politically powerful even though the EU was voluntary and treaty-based, unlike Soviet domination. False equivalence still had electoral force.

Democratic backsliding

1. Hungary after 2010: Viktor Orban and Fidesz changed the constitution, weakened checks on government, pressured media independence, and reshaped courts.
   • Orban presented these changes as national sovereignty and illiberal democracy, while EU critics saw them as rule-of-law violations. Backsliding challenged accession assumptions.
   • Hungary still received EU funds and stayed inside the single market, which made punishment politically and legally difficult. Membership protection limited EU leverage.
2. Poland after 2015: the Law and Justice government clashed with the EU over judicial independence, constitutional courts, media, and minority rights.
   • EU institutions argued that judicial reforms undermined the rule of law, while Polish leaders argued they were correcting post-communist judicial privilege. Competing narratives shaped the dispute.
   • The conflict showed that EU membership did not permanently settle debates about liberal democracy, nationalism, and sovereignty. Democratic consolidation was not automatic.
3. Article 7 problem: the EU could begin proceedings against states accused of serious rule-of-law breaches, but major sanctions needed broad agreement among other members.
   • Hungary and Poland could protect each other by threatening vetoes, weakening the enforcement system. Mutual shielding exposed treaty limits.
   • This showed that the EU had stronger tools to shape countries before they joined than after they became members. Conditionality gap is the core issue.

How to judge enlargement

1. A major achievement: enlargement helped stabilise post-communist Europe, spread market access, support democratic institutions, and symbolically overcome the Cold War division of the continent.
   • For many citizens in Central and Eastern Europe, EU membership delivered travel, work, study, investment, and legal protections unavailable before 1989.
   • The achievement was real because no other institution offered the same mix of economic access and political recognition. European integration became continental.
2. A source of new tensions: enlargement also widened the EU’s economic gaps, increased migration debates, complicated decision-making, and exposed weak enforcement of democratic norms.
   • The same process that reunited Europe also made the EU more diverse and harder to govern. Scale brought complexity.
   • A strong judgement should therefore treat enlargement as both the EU’s post-Cold War success and the source of some of its later crises. Dual legacy is the safest conclusion.
