From Premier to Dictator: How the Leggi Fascistissime Destroyed Liberal Italy (1924-1926)

The Speech of January 3, 1925: Declaring Dictatorship

1. A calculated gamble: On January 3, 1925, after six months of political uncertainty following the Matteotti murder, Mussolini rose before the Chamber of Deputies and accepted "moral and political responsibility" for everything that had happened under Fascism, including, by implication, Matteotti's death, then dared the chamber to do something about it.
   1. "If Fascism has been a criminal association, if all the violence has been the result of a particular historical, political, and moral climate, the responsibility for this is mine," he said. "Italy, Gentlemen, wants peace, wants quiet, wants work, wants calm. I will give it these things with love if possible, and with force if necessary."
2. No one challenged him: The Aventine deputies were still absent, the Fascist-dominated chamber applauded, and the remaining Liberal and moderate deputies said nothing.
   1. The speech marked the transition from a parliamentary government that happened to be led by a Fascist, to an open dictatorship that would systematically destroy the institutions of liberal Italy over the next two years through the leggi fascistissime.

The Leggi Fascistissime: Dismantling Liberal Italy (1925-1926)

1. Laws issued one by one: Between 1925 and 1926, a series of laws historians call the leggi fascistissime ("Most Fascist Laws") systematically dismantled the institutions of liberal Italy. They were issued individually rather than in one moment of revolutionary legislation, making it difficult for opponents to organize a coherent response.
2. Government no longer answers to parliament: In December 1925, a law on the powers of the Head of Government made Mussolini responsible only to the King, not to parliament, so governments no longer needed parliamentary confidence.
   1. Also in December 1925, a press law required all newspaper editors to be registered with and approved by the state. Non-Fascist newspapers were closed or taken over.
3. Opposition parties banned: After a failed assassination attempt against Mussolini in Bologna in October 1926 supplied the pretext, all non-Fascist political parties were formally banned and dissolved that November. Remaining opposition deputies were expelled from the chamber.
4. Local democracy and unions destroyed: Also in 1926, elected local councils were abolished and replaced by appointed Podestà (local governors answerable to Rome), and the 1926 Rocco Law outlawed strikes and lockouts, placing labour relations under state supervision.
   1. The Palazzo Vidoni Pact of 1925 had already established that only Fascist unions would be recognized in collective bargaining, effectively destroying independent trade unionism, while a Special Tribunal for the Defense of the State was created to prosecute political opponents before military judges, bypassing the ordinary courts.

Italy as a One-Party State: Fascism's Nature and Limits

1. A near-total state by 1926: By the end of 1926, Italy had no free press, no opposition political parties, no elected local government, no independent trade unions, and a political police (OVRA) monitoring citizens for signs of dissent. Mussolini's title of Il Duce ("The Leader") was used in all official communications, and the Fascist Grand Council had become the supreme legislative authority alongside Mussolini himself.
2. But not fully totalitarian: The Catholic Church retained significant independence, reinforced by the Lateran Pacts of 1929, which recognized the Vatican as a sovereign state and Catholicism as the official religion. The monarchy continued to exist, with Victor Emmanuel III remaining head of state, and the army kept a degree of professional autonomy.
   1. Mussolini controlled these institutions through negotiation as much as coercion.
3. Authoritarian, not fully totalitarian: Most historians today describe Fascist Italy as authoritarian rather than totalitarian in the strict sense. Mussolini himself used the word "totalitarian" in 1925 ("tutto nello Stato, niente al di fuori dello Stato," or "everything within the State, nothing outside the State"), but the reality fell short of this.
   1. Compared to Hitler's Germany and Stalin's USSR, Fascist Italy killed fewer people, ran a less efficient surveillance system, and maintained more surviving spaces of non-Fascist life.

Mussolini Subordinated the Party to Himself

1. The ras lost their independence after 1925: Mussolini reined in the provincial Fascist bosses who had built the movement through local violence, replacing confrontational party secretary Roberto Farinacci with Augusto Turati in 1926, who turned the PNF into a disciplined bureaucracy that transmitted Mussolini's policy rather than generating its own.
2. The Fascist Grand Council later turned against him: it gained formal constitutional status in 1928 as the regime's supreme advisory body, but in July 1943, facing military defeat, this same body voted to remove Mussolini from power, showing that even Fascism's own central institution was never simply his personal instrument.
